1. General Information

This website is operated by ACT LGBT AC, located at Agucate #314, Col. Emiliano Zapata, Puerto Vallarta, Jalisco, Mexico, CP 48380. By accessing this site and participating in our auctions, you agree to comply with the following terms and conditions.

2. Service Description

Subasta Vallarta Pride offers an online platform for auctioning art pieces using WooCommerce and YITH Auctions. All users must be registered to participate in the auctions.

3. Participation Rules – Futuramar Auction

To provide a clear, fair, and satisfactory experience during the live auction, we present the following rules governing participation:

Registration and Participation Deposit

(Modes: in-person, remote, and absentee) To participate in the auction, it is mandatory to register in advance. You can do so by sending a WhatsApp message to +52 33 1045 6160 or via direct message on Instagram @tierrafisicaart

Catalog Consultation

Before the auction, we recommend carefully reviewing the catalog of works. If you are interested in acquiring a piece, make sure it meets your expectations. The works are sold as-is. No returns or cancellations are accepted once a lot is awarded.

Auction Dynamics
  • The auctioneer will announce each lot, providing a brief description of the work, its characteristics, and the starting price.

  • Collectors may place successive bids, improving the previous price.

  • The lot will be awarded to the last bidder when no more offers are made.

  • The final price will be the last announced by the auctioneer and must be fully covered by the buyer.

  • The bid increment will be approximately 10% or according to the auctioneer’s discretion.

  • The buyer agrees to sign the Award Sheet upon winning the lot.

Remote Participation

If you participate remotely or in absentee mode, a representative from the Art Advisors team will contact you if your bid is successful to coordinate payment and delivery details.

4. Payment Policy

  • Accepted payment methods are cash, bank transfer, and credit card.

  • Payments via bank terminal may include an additional percentage fee depending on the bank, up to 4%.

  • In the case of bank transfer payments, the delivery of the work will take place once the payment has been confirmed and the amount is firmly reflected in the bank account.

  • If the payment is made by credit card, the applicable bank charge will be applied.

  • If an invoice is required, you must provide your tax certificate at the time of payment. The artwork price will be plus VAT if an invoice is requested.

  • All prices are expressed in Mexican Pesos (MXN) and US Dollars (USD).

Auction Fee (Hammer Fee)

An additional 8% fee corresponding to the auction service will be added to the final lot price.

5. Delivery, Packaging, and Transportation

  • The packaging, transportation, and insurance of the works are the responsibility of the buyer.

  • For international shipments, the collector must handle all logistical arrangements.

  • Awarded pieces must be paid for and delivered on the same day of the auction.

6. Dispute Resolution

In case of doubt or conflict during the auction, the auctioneer’s decision will be final.

7. Data Protection

  • Personal information provided during registration will be used exclusively for the auction and billing process.

  • We do not share personal data with third parties without prior consent.

8. Amendments to the Terms

ACT LGBT AC reserves the right to modify these terms at any time. Any changes will be promptly posted on the website.
